OFFICIAL RULES. The following are the official rules (“Rules”) for the PetLink Sweepstakes (the “Sweepstakes”). In order to enter the Sweepstakes, you must agree to these Rules. You agree that submission of an entry form and/or participation in the Sweepstakes constitutes your agreement to these Rules.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
Eligibility: The Sweepstakes is open only to legal residents of the contiguous forty-eight (48) states of the United States, Hawaii, Alaska, and the District of Columbia who are 18 years of age or older at the time of entry. Employees of Sponsor and its respective parent, affiliates, subsidiaries, Sweepstakes agencies, suppliers and members of their immediate families, are not eligible. Void in Puerto Rico and where prohibited by law. For purposes of the Sweepstakes, “immediate family” is defined as spouses, parents, children, siblings and their respective spouses, regardless of whether they reside in the same household.
Sponsor: This Sweepstakes is sponsored by Datamars, Inc, with its principal place of business at 345 West Cummings Park, Woburn, MA 01801, (“Sponsor”).
Timing: The Sweepstakes begins at 9 am EST on Sunday, May 5, 2024 until 11:59 pm EST on Saturday, May 11, 2020 (“Sweepstakes Period”).
Entry: To enter the Sweepstakes, during the Sweepstakes Period, participants must: (1) Follow @PetLink_Official on Instagram. A purchase or payment of any kind will not increase your chances of winning; (2) Comment on the National Pet Week Reel video posted on 5/52024 with your pet’s favorite activity and entry must include #PetLinkSweep in the comment through 11:59 pm EST on Saturday, May 11, 2024.
One (1) winner (“Winners”) will be randomly selected from the pool of Entries. Entrants must have a valid public Instagram account to be eligible to enter. Acceptions will be made for private accounts if they check their direct messages and accept @PetLink_Official’s direct message request on Instagram to verify eligibility on or before May 17, 2024. No more than one (1) person can enter using the same Instagram account. There is no limit on the number of Entries an Entrant may submit. Use of any automated system to participate is prohibited and will result in disqualification. The Sweepstakes is not sponsored by Instagram, Inc.
Entry Errors: Sponsor is not responsible for lost, late, incomplete, damaged, stolen, invalid, unintelligible or misdirected entries, which will be disqualified. Sponsor is not responsible if online service or equipment is interrupted including without limitation: (1) interruptions to any network, server, Internet, Web site, telephone, satellite, computer or other connections, (2) failures of any telephone, satellite, hardware, software or other equipment, (3) garbled, misdirected or jumbled transmissions, or traffic congestion, (4) other errors of any kind, whether human, technical, mechanical or electronic, (5) the incorrect or inaccurate capture of information or the failure to capture any such information, or (6) printing or typographical errors.
Selection of Winner: Sponsor will select one (1) Winner at random from the pool of Entries received during the Sweepstakes Period (the “Entries”). Odds of winning depend on the number of eligible Entries received during the applicable Sweepstakes Period. The Winner will be notified via direct message on Instagram within seven (7) business days after the Sweepstakes Period ends. Entrants are responsible for checking their Instagram messages ensuring that their Instagram information is up-to-date and accurate. Prize notices returned as undeliverable will result in the disqualification of the potential prize Winner and an alternate Winner will be selected. Sponsor’s decisions as to the random drawing are final and no correspondence will be entered into. Winner will have twenty-four (24) hours to respond and claim their Prize via direct message from @PetLink_Official or E-mail message from lauren.piandes@datamars.com. If the Winner is discovered to be invalid for any reason prior to delivery of the Prize, or if the Winner cannot be contacted or does not respond within the twenty-four (24) hour time period, an alternate Winner may be selected, at the sole discretion of the Sponsor. If there is no Winner by the 30th day after end of Sweepstakes, no further Winners will be chosen. In the event of a dispute, the person to who the Instagram account used to enter the Sweepstakes was registered will be deemed the winning Entrant. Potential Winner may be required to show proof of identification and provide social security number upon request in conjunction with Prize award/acceptance.
Prizes: The following “Prize” awarded in this Sweepstakes is dependent on number of Entries received during the Sweepstakes Period: One Winner will receive one (1) $250 Petco or Petco.com gift card, which will be shipped or emailed to the winner within one month of the Sweepstakes. No other Prizes will be awarded. Limit one (1) Prize per Winner. All results and decisions of Sponsor are final and binding in all respects. The Prize cannot be combined with any other offer. Prizes are non-transferable or redeemable in cash and must be accepted as awarded. Each Prize is awarded “as is” with no warranty or guarantee, either express or implied outside of manufacturer’s limited warranty. No transfer, assignment or substitution of a Prize permitted, except Sponsor reserves the right to substitute Prize for an item of equal or greater value in the event an advertised Prize is unavailable. Winner is required to comply with any and all applicable federal, state, and local laws, rules and regulations. All federal, state and local taxes, and any other costs not specifically provided for in these Official Rules are solely the Winner’s responsibility. Winner is under no obligation to join memberships or subscriptions to redeem gift card value and may elect to checkout as a “guest” customer.
Acceptance of Official Rules: As a condition of entry, participants fully and unconditionally agree to these Official Rules, to the Terms and Conditions of Prize Drawings and to Sponsor’s decisions, which are final and binding in all respects. Sponsor’s failure to enforce any provision of these Official Rules shall not constitute the waiver of such provision.
Potential Winner(s), Publicity: As a condition of entry, you grant consent to Sponsor, and its affiliates to use your name, likeness, voice, and biographical information for publicity or advertising in any media or manner, including website posting discussing Winner’s involvement in the Sweepstakes, without payment, consideration, notice or approval and without geographic or time limitation, except where prohibited by law.
Liability: You agree that Sponsor and each of its respective parent, subsidiaries and affiliates and all its advertising and Sweepstakes agencies, as well as Instagram, Inc. and its prize partners (the “Released Parties”), will have no liability whatsoever in connection with this Sweepstakes and, you shall hold them harmless for any injuries, losses or damages of any kind that you or others may incur as a consequence of your participation in the Sweepstakes or your acceptance, use or misuse of the prize. By entering the Sweepstakes, Entrant explicitly releases, discharges and holds harmless the Sponsor, and each of its successors and assigns and all its respective shareholders, directors, officers and employees, as well as Instagram, Inc. and its prize partners, one and all, from any and all liability, actions, causes of action, damages, actual, incidental or consequential, claims and demands whatsoever in law or equity, including attorneys’ fees and/or experts fees and costs, which he/she now has or may acquire, by reason of any personal injury, death, loss of or damage to property, or any reason, occurring during or arising out of his/her participation in the Sweepstakes and the acceptance and use or misuse of the prize. The Released Parties are not responsible for any injury or damage to persons or property, which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Sweepstakes or receipt or use or misuse of the Prize.
Conditions of Participants’ Conduct: Sponsor reserves the right in its sole discretion, to modify, cancel, terminate, and/or suspend the Sweepstakes and to disqualify any individual who tampers with the entry process, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Without limiting the foregoing, Sponsor may lock out any Entrant who, in Sponsor’s sole judgment, has been disqualified, has questionable eligibility or is otherwise ineligible to enter.
Disputes/Choice of Law: Except where prohibited, each Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or the awarding of the Prizes shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in State of California (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (3) no punitive, incidental, special, consequential or other damages, including without limitation, lost profits, may be awarded (collectively, “Special Damages”), and (4) Entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. California Law, without reference to choice of law rules, governs the Sweepstakes and all aspects related thereto.
Indemnification: TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU HEREBY AGREE TO INDEMNIFY, RELEASE AND HOLD HARMLESS SPONSOR AND EACH OF ITS RESPECTIVE PARENT, AFFILIATES, AND SUBSIDIARIES AND EACH OF THEIR RESPECTIVE SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES, LICENSEES, SUCCESSORS, REPRESENTATIVES AND AGENTS AT ALL TIMES FROM AND AGAINST ANY AND ALL CLAIMS, ACTIONS, LOSSES, LIABILITIES, DAMAGES, PROCEEDINGS, COSTS (INCLUDING ATTORNEYS’ FEES) AND EXPENSES FOR ANY INJURY, DAMAGE OR LOSS CAUSED OR CLAIMED TO BE CAUSED, BASED UPON, OR ARISING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE OR ANY PART OF THE PRIZE, ENTERING THE SWEEPSTAKES, PARTICIPATION IN THE SWEEPSTAKES, OR PARTICIPATION IN ANY PRIZE RELATED ACTIVITY OR EVENT.
In no event shall Sponsor be liable to a Winner or Entrant for any indirect, incidental, consequential, special or punitive damages of any kind, whether in contract, tort, negligence, strict liability, statutory or any other theory of liability arising from or related to the Sweepstakes, or any aspect of Winner’s or Entrant’s participation in or termination from the Sweepstakes as provided herein, even if Sponsor has been advised of the possibility of such damages. In no event shall Sponsor be liable to a Winner or Entrant for any amount with respect to Winner’s or Entrant’s participation in or disqualification from the Sweepstakes, or from the termination or cancellation of the Sweepstakes. To the extent permitted by law, the rights to litigate, seek injunctive relief or to any other recourse to judicial or any other procedure in case of disputes or claims resulting from or related to the Sweepstakes are hereby excluded, and you expressly waive any and all such rights.
General: In any section, provision, term or clause shall be held or found to be unenforceable or invalid by a court decision, statute, rule or otherwise, the remaining provisions shall not be affected thereby and shall continue in full force and effect and such provision may be modified or severed from these Rules to the extent necessary to make such provision enforceable and consistent with the remainder of these Rules. This Sweepstakes is governed by the laws of the State of California, United States. All federal, state and local laws and regulations apply. By entering and participating in the Sweepstakes, you agree to be bound by these Rules and by Sponsor’s decisions, which are final and binding on all matters relating to the Sweepstakes. Entrants are required to provide accurate, valid and truthful information at all times. Sponsor will reject and delete any Entry that it discovers to be false, fraudulent, illegal or deceptive and will disqualify any entrant who tampers with the Entry process, the operation of the Sweepstakes, or is otherwise in violation of the Rules. Sponsor is not responsible for electronic transmission errors which result in the omission, interruption, deletion, defect, destruction, alteration, and/or delay of any Entry. Sponsor is not responsible for any technical, network, electronic, computer, hardware and/or software malfunction, problem, incompatibility, congestion or failure of any kind. Sponsor reserves the right to cancel, terminate or modify the Sweepstakes at any time, in its sole discretion, if the Sweepstakes is not capable of completion as planned, including without limitation, the lack of Entry submissions, incomplete Entries, computer viruses, bugs, tampering, unauthorized intervention or technical failures of any sort, without notice. Upon cancellation or termination of the Sweepstakes for any reason, Sponsor shall have no obligation to award prizes or compensation of any kind.
By submitting an Entry and participating in the Sweepstakes, you represent and warrant that (i) your Entry is original and that you are the sole and exclusive owner and rights holder of the submitted Entry, or you have obtained the necessary permission to include the Entry in the Sweepstakes, and that you have the right and authority to submit
NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
THIS Sweepstakes IS INTENDED FOR PARTICIPATION IN THE UNITED STATES. DO NOT PARTICIPATE IN THE Sweepstakes IF YOU DO NOT FALL WITHIN THE ELIGIBILITY REQUIREMENTS AS SET FORTH BELOW. THIS Sweepstakes IS VOID WHERE PROHIBITED.
THESE OFFICIAL TERMS AND CONDITIONS CONTAIN AN ARBITRATION AGREEMENT, WHICH REQUIRES THAT UNLESS SPECIFICALLY PROHIBITED BY APPLICABLE CONSUMER PROTECTION LEGISLATION ALL DISPUTES BE RESOLVED SOLELY BY BINDING ARBITRATION, AND ENTRANTS AGREE TO ONLY PURSUE CLAIMS AGAINST SPONSOR AND/OR SEEK RELIEF ON AN INDIVIDUAL BASIS, AND ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT, OR AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING.
The following are the official terms (“Terms”) for the PetLink Winnie Sweepstakes (the “Sweepstakes”). By entering, you agree to these Terms. Participation constitutes acceptance.
Sponsor
This Sweepstakes is sponsored by Datamars, Inc., located at 1110 Industrial Boulevard, Temple, TX 76504 (“Sponsor”).
Timing
The Sweepstakes begins at 11 a.m. EST on Friday, June 19, 2026 and ends at 11:59 p.m. EST on Monday, July 6, 2026 (“Sweepstakes Period”).
Eligibility
The Sweepstakes is open only to legal residents of the 48 contiguous United States (excluding Rhode Island), Alaska, Hawaii, and the District of Columbia, who are 18 years of age or older at the time of entry. Officers, directors, and employees of Sponsor, affiliates, subsidiaries, agencies, suppliers, and their immediate families are not eligible. Void in RI and where prohibited. Odds of winning depend on number of eligible entries received.
How to Enter
There are two (2) ways to enter the Sweepstakes:
Photo Entry:
During the Sweepstakes Period, participants may enter the Sweepstakes by visiting the official entry page created by the Sponsor at https://woobox.com/7t7khv (the “Entry Page”). To enter:
(i) visit the Entry Page and follow the on-screen instructions to upload an original photo of your dog. Photo must clearly show your dog’s face facing the camera; and
(ii) provide all required contact information, including a valid email address.
Upon completing the required steps, Entrants will receive one (1) entry into the Sweepstakes. Entries submitted outside the Sweepstakes Period are invalid and will not be entered to win.
The Entry must meet the following “Entry Guidelines”:
(i) the Entry must be the submitting entrant’s original, previously unpublished work and not feature or focus on any copyrighted material, logos, or trademarks that are owned by third parties; and
(ii) the Entry must not include imagery, text, or subject matter that is deemed by the Sponsor to be obscene, profane, pornographic, libelous, or otherwise objectionable.
Each entrant must provide a valid email address to enter the Sweepstakes and to be eligible to receive winner notification. Only one (1) person may enter per email address.
Free Alternative Entry:
Entrants may receive one (1) entry by emailing petlinkeventsus@datamars.com with the subject line PetLink World Pup Photo Sweepstakes Entry. Include your full name, date of birth, state of residence, and a statement that you have read and agree to these Official Terms and Conditions. Email entries must be received during the Sweepstakes Period and by 11:59 p.m. EST on July 1, 2026.
Limit one (1) entry per dog, regardless of method of entry. Entrants with multiple dogs owned by or associated with the same PetLink account may submit one (1) entry for each different dog. Duplicate entries featuring the same dog are prohibited. You may not enter more times than indicated by using multiple e-mail addresses, identities or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Sponsor. Entrants who do not follow all the instructions or abide by these Official Terms and Conditions or other instructions of Sponsor may be disqualified. Multiple entrants are not permitted to submit entries featuring the same dog or to share the same Email account for the purpose of entering the same dog. Any attempt by any entrant to obtain more than the stated number of entries for the same dog by using multiple/different email addresses, accounts, identities, registrations, logins, or any other methods may void that entrant’s entries and that entrant may be disqualified, at the Sponsor’s discretion. Use of any automated system to participate is prohibited and may result in disqualification, at the Sponsor’s discretion. In the event of a dispute regarding the identity of the entrant, the entry will be deemed to have been made by the Authorized Account Holder of the Email account used to submit the entry.
“Authorized Account Holder” is defined as the natural person who is assigned an Email account by the respective social media entity or other organization which is responsible for assigning such accounts or the domain associated with the submitted entry. Proof of submission of an entry shall not be deemed proof of receipt by Sponsor. A potential winner may be required to provide identification sufficient to show that he/she is the Authorized Account Holder of the email address provided at the time of entry.
Sponsor’s Use of Entries: By posting a Comment in the Sweepstakes, entrant consents to and hereby grants to Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display the Comment, including without limitation the photo or any writing, in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes. If requested, entrant will sign any documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the Comment. Sponsor reserves the right to remove (and to require that entrant remove) and to disqualify Comments or entries that are off-topic, violate the guidelines outlined above, violate these Official Rules, or for which a DMCA notice or other infringement claim is received.
Prize Details
- Eleven (11) participants will be randomly selected from all eligible entries to be featured in the PetLink World Pup lineup and received during the Sweepstakes Period.
- Eleven (11) winners will receive one (1) PetLinkGPS tracker device and one free month access to PetLinkGPS app
PetLinkGPS is subject to additional terms and conditions that the issuer imposes on its device which are accessible online. No cash alternative or substitution of prizes will be allowed, except Sponsor reserves the right in its sole discretion to substitute prize of comparable value if any prize listed is unavailable, in whole or in part, for any reason. Gift cards cannot be used to purchase a subscription from Sponsor’s website. Other restrictions may apply. Approximate Retail Value (ARV) of each prize: $76.99. Total ARV of all prizes: $846.78
Each prize includes one (1) PetLinkGPS device and a one-month free trial of the PetLinkGPS app subscription. Continued use of the GPS device beyond the trial period requires an active app subscription, which must be purchased separately by the winner if they choose to continue service. Winners are under no obligation to renew or purchase a subscription and may discontinue use of the device and app at any time after the free trial expires.
Winner Selection & Notification
Winner will be selected randomly from the pool of entries on or before July 10, 2026 from the pool of eligible entries. Winner will be notified via email and emailed within 10 days of selection. Potential winner who do not respond within 48 hours may forfeit their prize. If the prize or winner notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected.
General Conditions
- Non-transferable. Limit one (1) PetLinkGPS per PetLink account.
- Winner are responsible for all applicable federal, state, and local taxes.
PUBLICITY RELEASE
By participating in the Sweepstakes, in addition to any other grants which may be granted in any other agreement entered into between Sponsor and any entrant and/or winner of the Sweepstakes, except where prohibited each entrant irrevocably grants Sponsor and their respective successors, assigns and licensees, the right to use such entrant’s name, social media tag, likeness, Comment, and biographical information, and any other personal characteristics, in any and all media for any purpose, including without limitation, to advertise, market, and promote the Sponsor, or the Sweepstakes or other promotions, and each entrant and/or prize winner(s) hereby release the Sponsor from any liability with respect thereto.
Liability Release
Sponsor is not responsible for incorrect or inaccurate entry information whether caused by internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes, including but not limited to the Email, social media platforms, or by any technical or human error which may occur in the transmission, receipt or processing of the entries. Sponsor is not responsible for computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature. Sponsor is not responsible for any computer or e-mail failures that may result in lost or garbled entries or which affect the administration of the Sweepstakes. Sponsor assumes no liability for incorrect, lost, late, stolen, illegible, incomplete, misdirected, damaged non-delivered requests or entries, computer system or transmission line errors, software or hardware malfunctions, or other errors, failures, or delays in transmission that are human, mechanical or technical in nature, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from downloading or entering any part of this Sweepstakes. If, for any reason, the Sweepstakes, in the sole opinion of Sponsor, is not capable of running as planned in the sole opinion of the Sponsor, or should fraud, a virus, bugs, or other causes beyond the control of Sponsor corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes, and randomly determine the winner in a random drawing from among all eligible, non-suspect entries received prior to action taken, or as otherwise deemed fair and equitable by Sponsor. Sponsor reserves the right at its sole discretion, to disqualify any individual (and his/her entry) who tampers with the entry process.
By entering, participants release and hold harmless Sponsor, affiliates, subsidiaries, and their directors, officers, and employees from any liability arising out of or related to (a) participation in the Sweepstakes or prize acceptance, use, or misuse, (b) the violation of any third-party privacy, data security, personal, publicity or proprietary rights, (c) typographical or printing errors in these Official Rules or any Sweepstakes materials, (d) any interruptions in or postponement, cancellation or modification of the Sweepstakes, (e) any lost/delayed data transmissions, omissions, interruptions, defects, and/or any other errors or malfunctions, or (f) the negligence or willful misconduct by entrant. Each entrant agrees that Sponsor has not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose.

By participating in this Sweepstakes, each entrant agrees: (i) that any and all disputes entrant may have with, or claims entrant may have whether in contract, tort, statute or otherwise (including the interpretation and scope of this arbitration provision, and the arbitrability of the claim or dispute), between entrant and the Sponsor, or between entrant and any third parties if entrant asserts a claim against such third parties in connection with a claim entrant asserts against the Sponsor relating to, arising out of or connected in any way with (a) the Sweepstakes, (b) the awarding or redemption of any prize, and/or (c) the determination of the scope or applicability of this agreement to arbitrate and/or (d) any aspect of entrant's relationship with the Sponsor (including but not limited to, claims relating to advertising), will be resolved exclusively by final and individual binding arbitration administered by JAMS and conducted before a sole arbitrator in accordance with the rules of JAMS, including, if applicable, the JAMS Mass Arbitration Procedures and Guidelines; (ii) this arbitration agreement is made pursuant to a transaction involving interstate commerce, and shall be governed by the Federal Arbitration Act (“FAA”), 9 U.S.C. §§ 1-16; (iii) the arbitration shall be held in Temple, Texas; (iv) the arbitrator’s decision shall be controlled by the terms and conditions of these rules and any of the other agreements referenced herein that the applicable entrant may have entered into in connection with the Sweepstakes; (v) the arbitrator shall apply Texas law, consistent with the FAA and applicable statutes of limitations, and the arbitrator shall honor claims of privilege recognized at law; (vi) there shall be no authority for any claims to be arbitrated on a class or representative basis, arbitration can decide only entrant’s and/or Sponsor’s individual claims; the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; (vii) the arbitrator shall not have the power to award punitive damages against the entrant or Sponsor; (viii) if the entrant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, the Sponsor will pay as much of entrant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive; and (ix) with the exception of subpart (vi) above, if any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, or otherwise conflicts with the rules of JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, subpart (vi) is found to be invalid, unenforceable or illegal, then the entirety of this arbitration provision shall be null and void, and neither entrant nor Sponsor shall be entitled to arbitrate their dispute. By participating in this Sweepstakes each entrant expressly agrees, and the Sponsor hereby expressly agrees, to the application of the JAMS Mass Arbitration Procedures and Guidelines in the event of any “Mass Arbitration” as defined therein.
THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL OR INCIDENTAL DAMAGES OR HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
ENTRANTS AGREE THAT THE RIGHTS AND OBLIGATIONS OF ANY ENTRANT AND/OR SPONSOR AND/OR ANY OTHER PARTY SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT, OR AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING.
ANY DEMAND FOR ARBITRATION MUST BE FILED WITHIN ONE (1) YEAR FROM THE END OF THE PROMOTION PERIOD, OR THE CAUSE OF ACTION SHALL BE FOREVER BARRED.
GOVERNING LAW AND JURISDICTION
Except where prohibited by applicable local consumer protection laws, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Terms and Conditions, or the rights and obligations of Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Texas, U.S.A. without giving effect to the conflict of laws rules thereof, and any matters or proceedings which are not subject to arbitration as set forth in these Official Terms and Conditions and/or for entering any judgment on an arbitration award, shall take place in the State of Texas.
The invalidity or unenforceability of any provision of these Official Terms and Conditions shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Terms and Conditions shall otherwise remain in effect and, except as expressly stated otherwise, shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
